ARCHITECTURAL CONTROLS AND STANDARDS FOR IMPROVEMENTS ON MEMBER LOTS
No building, fence, wall or other structure shall be commenced, erected or maintained upon any Lot nor shall any exterior addition to, or change or alteration thereof be made until the plans and specifications showing the nature, kind, shape, height, materials, and location of the same shall have been submitted to and approved in writing, as to harmony of external design and location in relation to surrounding structures and topography, by the Board of Directors. For changes to existing structures, only items that meet the definition of “Structural Alterations” as defined in the “Zoning Regulations of Franklin County, Kansas” require approval by the Timbers Homes Association Board of Directors
STRUCTURAL ALTERATION: Any change in a structure other than normal repairs and maintenance which may prolong its useful life; or the useful life of its supporting members such as bearing walls or partitions, columns, beams, girders or foundations; or any complete rebuilding of the roof; or the exterior walls; or the construction of any addition to or enlargement of a structure; or the removal of any portion of a structure. For the purpose of these Regulations, the following shall not be considered a structural alteration:
Attachment of a new front where structural supports are not changed
Addition of fire escapes where structural supports are not changed
New windows or doors where lintels and support walls are not materially changed
Repair or replacement of non-structural members
Additional guidance for roofing: a change from asphalt shingles to another type of material such as stamped metal, slate, clay, concrete, or composite (polymer, rubber, or plastic) shingles will require Board of Director approval
New, or structural alterations to, existing buildings, fences, walls, or other structures will require approval by the Board of Directors. Approval is obtained by submitting a completed “Architectural Review Application” which will be reviewed by the Architectural Control Committee who will make a recommendation to the Board of Directors for approval or denial
New, or structural alterations to, existing buildings, fences, walls, or other structures s must comply with the use restrictions described in Article VII of The Timbers Homes Association Declaration of Covenants, Conditions, and Restrictions dated November 29, 2023, as well as all Franklin County Kansas regulations and permitting requirements
